Service Description
Idaho Pest Control provides professional pest management and extermination services to residential and commercial properties throughout the State of Idaho. Our services include, but are not limited to, inspection and identification of pest infestations, treatment and removal of common Idaho pests such as ants, spiders, rodents, wasps, boxelder bugs, and other nuisance wildlife, implementation of integrated pest management strategies, preventive treatments and maintenance programs, and consultation on pest-proofing and sanitation practices. Specific treatment methods, products used, and service frequency will be determined based on property conditions, pest type, environmental factors, and applicable regulations. All services are performed by licensed technicians in accordance with Idaho state law and federal guidelines governing pesticide application and pest control operations. Estimates and service agreements are provided on a per-property basis following initial inspection. We reserve the right to decline service for properties that present safety hazards, are inaccessible, or fall outside our operational service area.
No Guarantee or Warranty
Idaho Pest Control makes no express or implied guarantees, warranties, or representations regarding the complete or permanent elimination of pests from any treated property. Pest control results vary based on numerous factors outside our reasonable control, including but not limited to neighboring infestations, structural conditions of the property, weather events, customer compliance with recommended practices, reintroduction of pests by occupants or visitors, and the biological characteristics of target pest species. We do not warrant that treatments will prevent future infestations or that properties will remain pest-free for any specific duration following service. Any recommendations for follow-up treatments, maintenance schedules, or structural modifications are advisory in nature and do not constitute a guarantee of results. Customer acknowledges that pest management is an ongoing process requiring cooperation between the service provider and property owner or occupant.
User Responsibilities
Customers and property occupants bear significant responsibilities to ensure service effectiveness and safety. You must provide accurate and complete information regarding property conditions, known pest activity, previous treatments, presence of children or pets, and any chemical sensitivities or allergies prior to service. You are responsible for preparing the property as instructed, which may include removing food items, covering fish tanks, securing pets, and ensuring technician access to treatment areas. You must comply with all post-treatment instructions, including re-entry timelines, ventilation requirements, and cleaning restrictions. Failure to disclose relevant information or follow preparation and post-treatment guidelines may reduce treatment effectiveness and void any service commitments. You warrant that you have legal authority to authorize pest control services for the property in question. For rental properties, property managers and landlords must coordinate with tenants and obtain necessary access permissions.
Limitation of Liability
To the maximum extent permitted by applicable law, Idaho Pest Control and its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, loss of use, business interruption, personal injury, emotional distress, or damages related to pest-related property damage occurring before, during, or after treatment. Our total cumulative liability for any claim shall not exceed the total amount actually paid by customer for the specific service giving rise to the claim. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. Customer assumes all risk of property damage or personal injury related to pre-existing conditions, structural defects, or undisclosed hazards. You agree to indemnify and hold harmless Idaho Pest Control from claims arising from your breach of these terms, misrepresentation of property conditions, or failure to follow instructions.
Intellectual Property
All content, materials, and intellectual property associated with Idaho Pest Control, including but not limited to our business name, logos, service marks, trade dress, website content, photographs, technical documentation, treatment protocols, customer communications, and marketing materials, are the exclusive property of Idaho Pest Control or its licensors and are protected by United States trademark, copyright, and other intellectual property laws. No license or right to use any such intellectual property is granted except as expressly authorized in writing. Customers may not reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without prior written consent. Any feedback, testimonials, or reviews provided by customers may be used by Idaho Pest Control for marketing purposes without compensation. Unauthorized use of our intellectual property may result in civil and criminal penalties.
Governing Law
These Terms of Service and any disputes arising from or related to services provided by Idaho Pest Control shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Ada County, Idaho. Customer irrevocably submits to the personal jurisdiction and venue of such courts. The parties waive any objection to jurisdiction or venue based on forum non conveniens or any other basis. If any provision of these terms is held invalid or unenforceable under Idaho law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. These terms constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior agreements and understandings.
Changes to Terms
Idaho Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason at our sole discretion. Changes become effective immediately upon posting to our website or other notification to customers. Material changes affecting existing service agreements will be communicated with reasonable advance notice when practicable. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to any modified terms, you must discontinue use of our services and notify us in writing to terminate any ongoing service agreement. No oral modifications or waivers of these terms shall be effective. These terms may not be amended by customer purchase orders or other documents unless expressly agreed to in writing by an authorized representative of Idaho Pest Control.

All notices required under these terms shall be deemed given when actually received or, if sent by certified mail, three business days following posting.
